The law requires us to have a lawful basis for each way we use your information. The table below sets them out.

Purpose: To respond to enquiries and arrange and run your free Sales Review call
Lawful basis: Legitimate interests (responding to people who contact us), or steps taken at your request before entering into a contract

Purpose: To deliver our services if you become a client, including invoicing and account management
Lawful basis: Performance of a contract

Purpose: To send you our newsletter and marketing emails

Purpose: To contact businesses we think could benefit from our services (business-to-business prospecting by email, phone or LinkedIn)
Lawful basis: Legitimate interests (promoting our services to relevant businesses). We screen phone numbers against the Telephone Preference Service and the Corporate Telephone Preference Service where required, and we stop contacting you as soon as you ask.

Purpose: To run, secure and improve our website, and to understand how visitors use it
Lawful basis: Legitimate interests, and consent for non-essential cookies

Purpose: To keep business records, meet our tax and accounting obligations, and deal with legal claims
Lawful basis: Legal obligation and legitimate interests

Where we rely on legitimate interests, we have considered your rights and expectations and balanced them against our interests. You can ask us for more detail.

We don’t make decisions about you based solely on automated processing that have legal or similarly significant effects.

5. WHO WE SHARE YOUR INFORMATION WITH

We don’t sell, rent or lease your personal information.

We share information only with trusted service providers who help us run our business. They act on our instructions and must keep your information secure. They include:
– Our CRM, booking calendar, forms and email marketing platform: GoHighLevel / LeadConnector
– Email and document storage: Google Workspace
– Video calls: Zoom, Google Meet & Teams
– Website analytics: Google Analytics
– Accounting and payments: FreeAgent
– Members of our team and associates who deliver our services, all of whom are bound by confidentiality

We may also share information:
– with professional advisers such as our accountants, lawyers and insurers
– if we’re required to by law, or to protect our rights
– with a buyer or successor if our business, or part of it, is sold or reorganised

We may share anonymised results, such as “£185k of new business in one year”, in our marketing. We only name you or your business, or quote you, with your permission.

6. INTERNATIONAL TRANSFERS

Some of our service providers are based outside the UK.  When your information is transferred outside the UK, we make sure it is protected, for example by:
– using providers in countries the UK government has approved as having adequate protection, or certified under the UK Extension to the EU-US Data Privacy Framework, or
– using the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.

Contact us if you’d like more information about these safeguards.

7. HOW LONG WE KEEP YOUR INFORMATION

We keep personal information only for as long as we need it:
– Enquiries and Sales Review calls that don’t lead to work together: up to 2 years after our last contact
– Newsletter and marketing contacts: until you unsubscribe. After that, we keep your email address on a suppression list so we don’t contact you again.
– Client records, contracts and invoices: 7 years after our work together ends, to meet tax and legal requirements
– Website analytics data: up to 26 months [CONFIRM against your analytics settings]

We then securely delete or anonymise it.

8. HOW WE KEEP YOUR INFORMATION SAFE

We use appropriate technical and organisational measures to protect your information. These include access controls, password protection and two-factor authentication on our systems, and using reputable providers with strong security standards. No system is completely secure, but we work hard to protect your information. If a data breach is likely to put your rights at risk, we will tell you and the ICO as the law requires.

9. WHEN WE PROCESS INFORMATION FOR OUR CLIENTS

When we provide outsourced sales services to an MSP, for example running outbound campaigns or booking meetings on its behalf, we may handle personal information about that MSP’s prospects and customers. In that work we usually act as a processor for our client, which is the controller. We process that information only on our client’s written instructions and under a data processing agreement. If you are contacted by us on behalf of one of our clients, you can also contact that client directly about your information.

10. YOUR RIGHTS

You have the right to:
– ask for a copy of the personal information we hold about you
– ask us to correct information that is wrong or incomplete
– ask us to delete your information

– ask us to transfer your information to you or another organisation, in some circumstances
– withdraw your consent at any time, where we rely on consent. This doesn’t affect anything we did before you withdrew it.

To use any of these rights, email hello@jameswhite.business or write to us at the address in section 1. We may need to confirm your identity before we act. We will respond within one month, or tell you if we need longer for a complex request. There is usually no charge.

To stop receiving marketing emails, click “unsubscribe” in any email or email us.
